1. Acceptance of Terms
By registering for or using VesselSpecs ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
2. Description of Service
VesselSpecs is a B2B SaaS platform that enables maritime professionals to generate AI-powered technical refit specifications for superyachts. The Service is intended for professional use only.
3. Eligibility
The Service is available exclusively to businesses and professionals. Individual consumer use is not permitted. You must provide a valid corporate email address to register.
4. Subscription and Payment
Access to the Service is provided on a subscription basis. Fees are billed monthly in advance. All prices are exclusive of VAT, which will be applied where applicable under EU regulations. Subscriptions renew automatically unless cancelled before the renewal date.
5. Cancellation
You may cancel your subscription at any time from the Billing section of your account. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods.
6. Acceptable Use
You agree to use the Service solely for lawful professional purposes. You may not share your account credentials, resell access to the Service, or use the Service to generate content that is fraudulent, misleading, or harmful.
7. AI-Generated Content
Specifications generated by VesselSpecs are produced by an AI system and are provided as a professional drafting aid only. VesselSpecs does not warrant the accuracy, completeness, or fitness for purpose of any generated content. All specifications must be reviewed and validated by a qualified professional before use.
8. Data and Privacy
Your use of the Service is subject to our Privacy Policy. You retain full ownership of all data you input into the Service. VesselSpecs grants no rights over your data beyond what is strictly necessary to provide the Service. Data is processed and stored on infrastructure provided by BASE44 (United States). By using the Service, you acknowledge that your data may be stored on servers located in the United States. BASE44 is SOC 2 Type II and ISO 27001 certified and operates under Standard Contractual Clauses (SCCs) for international data transfers in compliance with GDPR. Specification content is processed by Anthropic's Claude Sonnet API solely to generate technical documents. Anthropic's API terms do not permit the use of API inputs or outputs for model training by default. No tenant data is used to train any AI model. Subprocessors used by VesselSpecs include BASE44 (infrastructure), Anthropic (AI generation), and Stripe (payments). A Data Processing Agreement (DPA) is available upon request by contacting hello@vesselspecs.com.
9. Intellectual Property
The VesselSpecs platform, including its software, design, and AI models, is the intellectual property of Efforwai Digital Transformation SL. You may not copy, modify, or reverse-engineer any part of the Service.
10. Limitation of Liability
To the maximum extent permitted by law, VesselSpecs shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the three months preceding the claim.
11. Service Availability
VesselSpecs is provided on a best-efforts basis. We do not guarantee uninterrupted or error-free access to the Service. Planned maintenance will be communicated in advance where possible. In the event of extended service unavailability exceeding 24 consecutive hours, affected subscribers may request a pro-rata credit for the affected period by contacting hello@vesselspecs.com. VesselSpecs relies on third-party infrastructure providers and AI services; interruptions caused by such providers are outside our direct control.
12. Governing Law
These Terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Barcelona.
13. Changes to Terms
We may update these Terms from time to time. We will notify you by email of any material changes. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
